1. Agreement to Terms

By accessing or using the POV mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the App.

2. Definitions

  • "Service" refers to the POV mobile application and all related services
  • "User" refers to anyone who accesses or uses the Service
  • "Bounty" refers to a location-based request for video or photo content
  • "Content" refers to videos, images, audio, and associated metadata
  • "Creator" refers to users who submit content for bounties
  • "Requester" refers to users who create and fund bounties

3. Account Registration and Eligibility

3.1 Account Creation

To use the Service, you must:

  • Be at least 18 years old
  • Register for an account
  • Provide accurate and complete information
  • Maintain the security of your account

3.2 Account Responsibilities

You are responsible for:

  • All activities under your account
  • Maintaining confidentiality of credentials
  • Notifying us of unauthorized use
  • Updating account information

4. Service Description

4.1 Core Services

POV provides a platform where:

  • Users can create location-based bounties for content
  • Users can fulfill bounties by submitting content
  • Payment is facilitated between parties
  • Content is stored and distributed

4.2 Bounty System

  • Requesters can create and fund bounties
  • Creators can view and accept bounties
  • Content must be created within specified locations
  • Payment is processed upon acceptance of content

5. User Conduct

5.1 General Conduct

You agree not to:

  • Violate any laws or regulations
  • Infringe on others' rights
  • Harass or intimidate others
  • Submit false or misleading information
  • Attempt to circumvent any security measures

5.2 Content Creation Guidelines

When creating content, you must:

  • Only film in public spaces
  • Respect privacy rights
  • Comply with local laws
  • Not create content in prohibited areas
  • Not endanger yourself or others
  • Not harass or stalk subjects
  • Not trespass on private property

5.3 Prohibited Content and Activities

Users must not create or submit content that:

  • Contains background music or copyrighted material
  • Reveals trade secrets or confidential business information
  • Shows private healthcare or medical activities
  • Captures religious ceremonies without permission
  • Records workplace activities without authorization
  • Reveals personal daily routines or patterns
  • Uses flash photography without warnings
  • Creates emotional distress or psychological harm
  • Damages professional reputations
  • Interferes with emergency services
  • Creates false emergencies or wastes public resources
  • Violates cultural or religious rights
  • Affects property values or business operations
  • Contains unauthorized voice recordings
  • Reveals insurance-sensitive activities

5.4 Technical and Device Usage

Users acknowledge:

  • Battery consumption from app usage
  • Potential device performance impacts
  • GPS and location inaccuracies
  • Technical malfunction possibilities
  • Network connectivity requirements
  • Storage space needs
  • Hardware compatibility requirements

5.5 Economic and Financial Terms

Users understand:

  • No guaranteed earnings
  • Market-dependent opportunities
  • Variable payment processing times
  • Competition effects on earnings
  • Economic condition impacts
  • Payment processor limitations
  • Tax implications of earnings

6. Content Rights and Licensing

6.1 Content Ownership

  • Creators retain ownership of their content
  • Creators grant specific licenses as detailed below
  • Content ownership disputes are subject to arbitration
  • We may remove disputed content pending resolution
  • Multiple claims may result in content removal
  • We do not arbitrate ownership disputes between users

6.2 License Grant

By submitting content, you grant:

  • To us: A worldwide, non-exclusive, royalty-free license to use, modify, distribute, and display the content
  • To Requesters: Rights as specified in the bounty terms
  • License terms survive account termination
  • Licenses cannot be revoked after content acceptance
  • Sub-licensing rights as necessary for operation
  • Right to remove content at our discretion
  • Right to modify content for technical purposes
  • Right to use content for platform promotion

6.3 Content Restrictions

Content must not:

  • Violate any laws or rights
  • Contain illegal or harmful material
  • Include private or confidential information
  • Infringe on intellectual property rights

6.4 Media Sales and Licensing

  • Content created through the App may be offered for sale to media organizations
  • All media sales are governed by the POV Media Licensing Agreement
  • Preview versions include POV watermark
  • Full rights granted only upon purchase
  • Metadata is included in content license
  • Bounty submissions include full licensing rights
  • 24-hour exclusivity period for bounty-accepted content
  • Creator retains rights to sell to other buyers after exclusivity
  • POV may facilitate direct sales to media organizations
  • POV charges facilitation fee for media sales
  • Content authenticity verified through metadata
  • Buyers must agree to Media Licensing Agreement
  • Creators must warrant content ownership
  • Media sales are final and non-refundable
  • POV reserves right to remove content from sale

6.5 Content Authenticity and Metadata

  • All content includes verified metadata
  • Location and heading data is certified accurate
  • Metadata tampering is prohibited
  • POV certifies content authenticity
  • Metadata is preserved through sale
  • Buyers receive full metadata access
  • Metadata use is restricted by license
  • POV maintains metadata integrity

7. Payment Terms

7.1 Bounty Payments

  • Requesters must fund bounties in advance
  • Payments are held in escrow until content acceptance
  • Fees may be deducted from payments
  • Payment processing is handled by third parties
  • All bounty terms must be clearly specified upfront
  • Payment amounts cannot be modified after bounty acceptance
  • Processing times and fees must be acknowledged
  • Users accept potential payment processing delays
  • Multiple payment attempts may be necessary
  • Payment disputes must follow our resolution process
  • We reserve the right to freeze payments during disputes
  • Chargebacks may result in account suspension

7.2 Refunds and Disputes

  • Bounty payments are generally non-refundable
  • Disputes will be handled according to our dispute resolution process
  • We reserve the right to make final decisions on disputes
  • Disputes must be filed within 30 days
  • Evidence must be provided for all disputes
  • Bad faith disputes may result in account termination
  • Mediation is required before legal action
  • Users agree to binding arbitration
  • Class action claims are waived

7.3 Taxes

Users are responsible for:

  • Reporting income
  • Paying applicable taxes
  • Maintaining tax records

8. Safety and Risk

8.1 User Safety

  • Users are responsible for their own safety
  • Do not engage in dangerous activities
  • Follow local laws and regulations
  • Use reasonable judgment

8.2 Risk Assumption

Users acknowledge and accept risks including:

  • Personal injury
  • Property damage
  • Legal disputes
  • Equipment damage
  • Confrontations during filming

10. Intellectual Property

  • The App and its content are owned by Kehl Group LLC
  • Users receive a limited license to use the App
  • No rights are transferred except as explicitly stated

  • All trademarks remain property of their owners
  • No license to use trademarks is granted

11. Liability and Disclaimers

11.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

11.2 Limitation of Liability

WE SHALL NOT BE LIABLE FOR:

  • Direct or indirect damages
  • Lost profits or data
  • Personal injury or property damage
  • Any claims related to content or bounties

11.3 Indemnification

You agree to indemnify us against any claims arising from:

  • Your use of the Service
  • Your content
  • Your violations of these Terms
  • Your interactions with other users

12. Termination

  • Extended inactivity

12.2 Effect of Termination

Upon termination:

  • Payment obligations remain

These Terms are governed by Wisconsin law.

  • Mandatory arbitration for unresolved disputes
