POV - End User License Agreement

1. Agreement to Terms

By downloading, installing, accessing, or using the POV mobile application ("App"), you agree to be bound by these terms and conditions ("Agreement") between you and Kehl Group LLC ("Company," "we," "us," or "our"). If you do not agree to this Agreement, do not download, install, access, or use the App.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the right, authority, and capacity to enter into this Agreement.

3. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on a device that you own or control.

4. User Responsibilities and Conduct

4.1 General Conduct

You agree to use the App in accordance with all applicable laws, rules, and regulations. You shall not:

• Use the App for any illegal purpose • Violate any applicable laws or regulations • Infringe upon the rights of others • Interfere with or disrupt the App or its servers • Attempt to gain unauthorized access to the App or its systems

4.2 Content Creation and Filming

When creating content through the App, you must:

• Only film in public spaces where filming is legally permitted • Not film in private property without explicit permission • Not film in areas where photography or videography is prohibited • Respect the privacy and rights of individuals who may appear in your footage • Not film through windows, into private spaces, or in semi-private areas even if visible from public spaces • Obtain consent when legally required • Exercise reasonable judgment in determining whether subjects have a reasonable expectation of privacy • Comply with all local, state, and federal laws regarding public photography and videography • Not use the App to harass, stalk, or intimidate others • Not create content that promotes illegal activities or violence • Immediately cease filming if requested by any subject • Exercise extreme caution while filming and maintain awareness of surroundings • Not engage in dangerous or reckless behavior while using the App • Not film in areas that may trigger medical conditions • Not film in ways that could interfere with emergency services or first responders • Not film in a manner that could reveal trade secrets or confidential business information • Not film in a way that could affect property values or business operations • Not film in or near medical facilities or treatment areas • Not film in a manner that could reveal patterns of behavior or daily routines • Not use flash photography without appropriate warnings • Not film cultural or religious sites without appropriate permissions • Not create content that could be used for stalking or tracking • Not create content that could interfere with workplace privacy • Exercise particular caution around minors and obtain parental consent when required • Not create content that could be used to discriminate or show bias • Not create content that could cause emotional distress or psychological harm • Not create content that could affect professional reputations • Ensure compliance with voice recording and publicity rights

4.3 Content Rights and Ownership

You retain ownership of the content you create through the App, but grant us certain rights as specified in Section 5.

4.4 Device and Technical Considerations

You acknowledge and agree that:

• The App may consume significant battery power due to GPS and video features • You are responsible for maintaining sufficient device power • Technical malfunctions may occur in location services • GPS data may have inherent inaccuracies • The App may impact device performance • You should maintain backup power sources • Location data may not be real-time accurate

4.5 Economic and Financial Acknowledgments

You understand and agree that:

• No specific earnings are guaranteed • Income potential varies by location and effort • Past earnings are not indicative of future results • We make no representations about potential earnings • Market conditions may affect bounty availability • Competition may affect earning potential • Payments may be subject to delays or processing times

5. Content License and Rights

5.1 User Content License

By submitting content through the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the App and our business.

5.2 Rights and Permissions

You represent and warrant that:

• You own or have the necessary rights to your content • Your content does not violate any third-party rights • You have obtained any necessary permits or permissions for filming • Your content complies with all applicable laws and regulations

6. Safety and Risk Assumption

6.1 Personal Safety

You acknowledge and agree that:

• You are solely responsible for your personal safety while using the App • The Company is not responsible for any physical harm or injury that may occur while using the App • You will exercise reasonable caution and judgment when fulfilling bounties or creating content • You will not put yourself or others in danger while using the App • You understand that using mobile devices while walking or in motion can be dangerous • You will maintain awareness of your surroundings at all times • You will not use the App while operating vehicles or machinery • You will not attempt to fulfill bounties in dangerous locations or situations • You assume all risks associated with using location-based services

6.2 Risk Assumption

You expressly assume all risks associated with using the App, including but not limited to:

• Personal injury or property damage • Confrontations with subjects of filming • Legal disputes arising from content creation • Loss or damage to equipment • Data loss or security breaches

7. Liability Limitations and Disclaimers

7.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Personal injury or property damage • Loss of data or privacy • Loss of profits or revenue • Legal costs or damages • Any other losses arising from use of the App • Inaccuracies in location data or services • Payment processing errors or delays • Content moderation decisions or outcomes • Disputes between users • Technical malfunctions or service interruptions • Actions of other users or third parties

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the App • Your content • Your violation of this Agreement • Your violation of any third-party rights • Your violation of any applicable laws or regulations

9. Payment and Financial Terms

9.1 Payments and Fees

• All payments and transactions are processed through third-party payment processors • We are not responsible for any payment processing errors or fees • All fees and charges are non-refundable unless required by law • We reserve the right to change our fee structure at any time

9.2 Tax Responsibilities

You are solely responsible for:

• Reporting and paying any applicable taxes on earnings • Maintaining accurate tax records • Complying with all tax laws and regulations

10. Termination

10.1 Termination by Company

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of this Agreement • Illegal or unauthorized use of the App • Behavior that poses a risk to public safety • Actions that could subject the Company to liability

10.2 Effect of Termination

Upon termination:

• Your license to use the App will immediately cease • You must uninstall and delete all copies of the App • Any outstanding payments or obligations will remain in effect

11. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Brown County, Wisconsin for any actions related to this Agreement.

12. Changes to this Agreement

We reserve the right to modify this Agreement at any time. We will notify you of any changes by posting the updated Agreement in the App. Your continued use of the App after such modifications constitutes your acceptance of the modified Agreement.

14. Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

This Agreement constitutes the entire agreement between you and the Company regarding the App and supersedes all prior agreements and understandings, whether written or oral.

By using the POV App, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

16. Accessibility and Non-Discrimination

The Company strives to make the App accessible to all users and prohibits discrimination based on:

• Disability status • Religious beliefs • Cultural background • Medical conditions • Professional status • Economic status

We will make reasonable accommodations where possible while maintaining essential App functionality.

17. Health and Safety

You acknowledge and agree that:

• The App may trigger various health conditions • You should consult healthcare providers about usage • Prolonged use may cause physical or mental strain • Addiction to bounty hunting is possible • You should take regular breaks • You should not prioritize bounties over health • You should maintain work-life balance

18. Emergency Services and Public Safety

You agree to:

• Not interfere with emergency services • Not create false emergency reports • Not impede first responders • Not create panic or false alarms • Not waste public resources • Yield to emergency vehicles • Follow all public safety directives
